
Last week was quite a busy time at the Bureau of Alcohol, Tobacco, Firearms and Explosives both in terms of leadership change and policy direction to ATF IOIs in the field.
Zero Tolerance Policy Repealed
On April 7th DOJ and ATF repealed the Enhanced Regulatory Enforcement Policy. This policy is, of course, better known as the “Zero Tolerance Policy” that caused hundreds of FFLs to be revoked over the past several years. Not because FFLs were doing anything intentionally wrong but because the previous administration chose to make simple clerical errors a death sentence.
This repealed policy provides FFLs and local ATF field offices with a path to repairing the broad damage Zero Tolerance caused. Industry and ATF worked for decades to provide a regulatory environment that encouraged partnerships on both improving compliance at the FFL Dealer level and, most importantly, deterring and prosecuting Straw Purchase offenders.
New ATF Acting Director Appointed
Additionally, ATF has a new Acting Director. On April 9th, former Acting Director Kash Patel was replaced by Dan Driscoll, who will also serve as the Secretary of the Army. Acting Director Driscoll’s appointment was celebrated by the National Shooting Sports Foundation who echo the industry’s belief that he will view the firearm industry as a partner to ATF in keeping firearms out of the hands of those who should not possess them.
What This Means for FFLs
With the new Administration and leadership at the Department of Justice, it is probably safe to say that these are just the beginning of positive changes for our industry. This doesn’t mean you can let your guard completely down. You still have regulatory responsibility like you have always had.
